3. Scope and legal basis

This privacy policy explains how we process personal data when you visit mcs-datalabs.com and when you contact us through our forms. Processing is based on the GDPR (Regulation (EU) 2016/679) and the German Federal Data Protection Act (BDSG) and TTDSG.

4. Data we process

4.1 Contact and lead forms

When you submit a contact form, we process the data you provide (e.g. name, company, email address, phone number, message content). This is necessary to respond to your request and, where applicable, to initiate a business relationship.

  • Purpose: handling your enquiry, B2B lead management.
  • Legal basis: Art. 6(1)(b) GDPR (pre-contractual measures) and/or Art. 6(1)(f) GDPR (legitimate interest in responding to enquiries). Where a consent checkbox is used, Art. 6(1)(a) GDPR.
  • Retention: We store your data until your enquiry has been fully handled. Data subject to statutory retention obligations (e.g. commercial or tax law) is kept for the legally required period and then deleted.

4.2 Server log files

Our hosting provider automatically collects and stores information in server log files (IP address, date and time, browser type, referrer URL). Legal basis: Art. 6(1)(f) GDPR (secure and stable operation of the website).

5. Cookies and consent

We use cookies and similar technologies. Non-essential cookies (analytics, advertising) are only set after you give consent via our consent banner, in accordance with § 25 TTDSG and Art. 6(1)(a) GDPR. You can withdraw or change your choice at any time via the cookie settings link. Technically necessary cookies are set on the basis of Art. 6(1)(f) GDPR.

6. Google services

6.1 Google Analytics 4

Subject to your consent, we use Google Analytics 4 to understand how visitors use our site. Provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Legal basis: Art. 6(1)(a) GDPR (consent). Data may be transferred to Google LLC in the USA on the basis of the EU-U.S. Data Privacy Framework and/or EU Standard Contractual Clauses.

6.2 Google Ads and conversion tracking

Subject to your consent, we use Google Ads conversion tracking to measure the effectiveness of our advertising. This may set cookies such as _gcl_au. Legal basis: Art. 6(1)(a) GDPR (consent). Google Consent Mode is used to transmit your consent choice to Google.

6.3 Google reCAPTCHA

We use Google reCAPTCHA to protect our forms against automated abuse. Legal basis: Art. 6(1)(f) GDPR (legitimate interest in security). Google’s privacy policy applies.

7. Recipients and processors

We engage service providers (hosting, analytics, advertising, form processing) as processors under Art. 28 GDPR. These include in particular our website hosting provider and Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (Google Analytics, Google Ads, Google Tag Manager, reCAPTCHA).

8. International transfers

Where data is transferred outside the EU/EEA (e.g. to Google LLC), such transfers rely on adequacy decisions, the EU-U.S. Data Privacy Framework, or Standard Contractual Clauses.

9. Your rights

Under the GDPR you have the right to access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction (Art. 18), data portability (Art. 20), and to object (Art. 21). You also have the right to lodge a complaint with a supervisory authority, e.g. the data protection authority competent for Berlin (Berliner Beauftragte für Datenschutz und Informationsfreiheit).
